General Terms of Use for the "AmaMi" App

I. Scope

These Terms of Use govern the contractual relationship between users of the “AmaMi” app (hereinafter referred to as the “App”) and the provider:

By registering in the App, you agree to these Terms of Use.

II. Subject matter of the agreement

The App provides users with personalized recommendations and suggested actions aimed at improving the quality of their personal relationships. The content provided is based on sound knowledge and the information entered by the user and includes specific measures that can be implemented immediately.
There is no entitlement to use the App. The provider may discontinue the App at any time without stating a reason.

Additional information:

The App is intended solely to provide information and support. No guarantee is given that the suggested measures will be successful or that a relationship will improve. Use of the App is not a substitute for professional advice, such as couples therapy or psychological counseling.

III. Eligibility

The App is intended exclusively for individuals who are at least 16 years old.

IV. Registration and user account

• Registration is required to use the App.
• You agree to provide truthful information when registering and to keep your login details confidential.
• Your user account is personal and may not be transferred to third parties.

V. User conduct

You agree to use the App only in accordance with applicable laws and these Terms of Use. In particular, the following are prohibited:

• Technically manipulating the App or circumventing security mechanisms
• Use by anyone under the age of 16.
• Using the App as an emergency or crisis service or as a substitute for therapy, diagnosis, or treatment.
• Entering or sharing third parties’ personal data without their consent; infringing personal rights, copyrights, trademarks, or other rights.
• Circumventing age, access, or security mechanisms; automated access, such as bots or scraping, or manipulation of features or score results.
• Distributing unlawful content; sharing login details; reverse engineering, decompiling, or modifying the App unless expressly permitted by law.

Your user account may be suspended or deleted in the event of a violation.

VI. Data protection

Information about the processing of personal data can be found in our Privacy Policy (Article 13 GDPR).

VII. Availability

The provider endeavors to make the App available with as few disruptions as possible. However, there is no entitlement to uninterrupted availability.

VIII. Liability

The provider shall be liable under Italian law as follows:

• Unlimited liability for damage caused by intentional misconduct (dolo) or gross negligence (colpa grave)
• In cases of ordinary negligence (colpa lieve), the provider shall be liable only:
  • for breaches of essential contractual obligations whose fulfillment is necessary for the proper performance of the agreement
  • limited to the foreseeable damage typically expected at the time the agreement was concluded
• Liability for indirect damage, loss of profits, and consequential damage is excluded to the extent permitted by law
• Statutory liability provisions for personal injury and mandatory consumer protection regulations remain unaffected

In all other respects, liability shall be governed by Articles 1218 et seq. and Articles 2043 et seq. of the Italian Civil Code (Codice Civile).

IX. Term and termination

• The user agreement is concluded for an indefinite period.
• You may delete your account yourself or submit a termination request to the provider at any time.
• The provider may terminate the agreement with 14 days’ notice or immediately suspend the account in the event of serious violations.

X. Changes to the Terms of Use

The provider may amend these Terms of Use where legitimate reasons exist, such as changes in the law, further development of the App, or security requirements.
You will be informed of any changes in good time. If you do not object to the changes within 30 days and continue to use the App, the changes will be deemed accepted.

XI. Terms of Use AmaMi AI Companion

1. Scope

These Terms of Use apply to the AI-powered chat “AmaMi AI Companion” within the AmaMi app. They supplement the general Terms of Use of the App. By starting the chat via the “Start chat” button, you agree to these terms; they are shown to you before first use and are available at any time in the App and at amami.online/en/terms-of-use. The AmaMi AI Companion is an optional additional feature – you can use the App in full without it.

The AmaMi AI Companion is available to registered users aged 16 and over.

2. What the AmaMi AI Companion is – and what it is not

2.1 Purpose

The AmaMi AI Companion is an AI-powered tool for personal reflection and orientation in questions of relationships and life. It can help you to organize your thoughts, broaden your perspectives, and find your own next steps.

2.2 Not professional advice

The AmaMi AI Companion is not a substitute for psychotherapy, psychological counseling, medical treatment, or legal advice. Its responses are prompts for reflection – not diagnoses, not treatment recommendations, not professional advice. If you need professional support, please turn to a qualified specialist.

2.3 Limitations of the AI

The AmaMi AI Companion is operated by an AI language model. This means:

• Responses may be incomplete, inaccurate, or in individual cases incorrect. Do not rely on the chat alone for important decisions.
• The AI may misunderstand emotional situations or respond inappropriately.
• Your conversation history remains stored in the App so that you can continue conversations across multiple sessions; you can delete it at any time. Your entries are not used to train the AI model.

3. Crises and emergencies

The AmaMi AI Companion is not a crisis intervention service and cannot help in acute emergencies.

4. Your obligations when using the service

You use the AmaMi AI Companion only for personal, non-commercial purposes. In doing so, you agree:

• not to enter any content that insults, defames, threatens, or discriminates against third parties;
• not to enter third parties’ personal data without their consent – when in doubt, do not refer to other people by their full name;
• not to misuse the chat to create or distribute unlawful content;
• not to pass on the chat’s responses to third parties as professional advice;
• not to make any attempt to circumvent the security or conduct requirements of the chat.

We may suspend access to the AmaMi AI Companion in the event of a violation.

5. Overview of data processing

When you use the AmaMi AI Companion, we process your chat entries in order to generate a response for you. For this purpose, we transmit the conversation content to our AI service provider Anthropic (Claude). A data processing agreement is in place with Anthropic; any transfer to the USA is safeguarded by EU Standard Contractual Clauses pursuant to Article 46(2)(c) GDPR. Your conversation history remains stored and linked to your account so that you can view it and continue conversations; you can delete it in the App at any time.

We do not store or evaluate conversation content for our own purposes. For quality assurance, we process only technical metrics without conversation content (e.g., response times, error messages, your voluntary ratings). If a specific legal dispute arises, we may retain the conversations concerned by way of exception until the dispute has been resolved.

Use of the AmaMi AI Companion requires your explicit consent to this data processing, because your entries may contain sensitive information – for example about health, your relationship, or your intimate life. You give this consent separately before first use. You may withdraw your consent at any time with effect for the future by e-mail to datenschutz[at]amami.online; the chat will then no longer be available to you. The withdrawal does not affect the lawfulness of the processing carried out up to that point.

You will find all details – data categories, legal bases, retention periods, recipients, and your rights – in our Privacy Policy for the AI Companion, which you can access at any time in the App and at amami.online/en/privacy-policy.

6. Liability

We are liable without limitation in cases of intent and gross negligence, as well as for injury to life, body, or health.

In cases of ordinary negligence, we are liable only for breaches of essential contractual obligations (obligations whose fulfillment is necessary for the proper performance of the agreement and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of agreement.

We give no warranty as to the accuracy, completeness, or suitability of the AI-generated responses; Section 2 applies accordingly. Mandatory statutory liability provisions, in particular under consumer protection and product liability law, remain unaffected.

7. Availability and changes

The AmaMi AI Companion is provided without any assurance of availability. We may further develop, restrict, or discontinue the feature.

We will announce changes to these Terms of Use in the App at least 14 days before they take effect. Material changes require your renewed consent; if you do not consent, you will not be able to continue using the AmaMi AI Companion from the date the changes take effect. The rest of the App remains unaffected.

8. Applicable law and dispute resolution

The law of the Republic of Italy applies. If you are a consumer whose habitual residence is in another country, the mandatory consumer protection provisions of your country of residence remain applicable, and you may also bring proceedings at your place of residence.

European Commission platform for online dispute resolution: ec.europa.eu/odr. We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body.

XII. Final provisions

• Italian law shall apply unless mandatory statutory provisions provide otherwise.
• If any individual provision of these Terms of Use is invalid, the validity of the remaining provisions shall remain unaffected.
